Service Terms

General operating terms for projects performed by Houston's Own.

1. Scope and agreement

These Service Terms are intended to apply when a customer hires Houston's Own for hauling, removal, cleanout, material recovery, loading/unloading, local delivery, property/facility support, appliance pickup, or related operational services. The written quote, invoice, work authorization, message thread, or other written scope for a particular job may add to or modify these terms. If a project-specific written term conflicts with these general terms, the project-specific written term controls for that project.

2. Estimates, quotes, and changes in scope

Quotes are based on the information reasonably available when prepared, including customer descriptions and photos. Pricing may change if the actual quantity, weight, material, access, stairs, distance, labor, equipment, disposal requirements, site conditions, or requested work differs materially from what was disclosed. Houston's Own will seek customer authorization for material scope or price changes before proceeding when reasonably practicable.

3. Customer authority

The customer represents that the customer owns the items being removed or has authority from the owner, property owner, property manager, tenant, employer, or other authorized party to direct the requested work. The customer is responsible for identifying items that must not be removed and for obtaining permissions required for access or removal.

4. Access and site conditions

The customer is responsible for providing lawful and reasonably safe access to the work area and for disclosing known conditions that could materially affect the work, including stairs, elevators, gates, restricted loading areas, unusually heavy items, pests, sharp objects, structural hazards, or other access or safety concerns. Houston's Own may stop, postpone, or modify work when conditions are materially different from those disclosed or present a safety, legal, equipment, or property risk.

5. Appliances

Unless Houston's Own specifically agrees otherwise in writing, appliances must be disconnected from electricity, gas, water, drain, vent, or other utility connections before arrival, emptied of food and personal property, and reasonably accessible for removal. Refrigerators and freezers must be emptied. Houston's Own may decline or reprice a pickup if an appliance is not ready or accessible as represented.

6. Hazardous, restricted, and undisclosed materials

Houston's Own may refuse materials that are hazardous, regulated, unsafe, unknown, leaking, contaminated, or outside the agreed scope. Examples include asbestos or suspected asbestos, medical or biohazardous waste, explosives or ammunition, fuels, certain chemicals, unknown liquids, and pressurized or otherwise regulated containers. Acceptance of any special material must be specifically agreed and legally permissible.

7. Removed materials and recovery rights

Unless the written scope states otherwise, once Houston's Own lawfully takes possession of items designated for removal, the customer authorizes Houston's Own to determine an appropriate disposition, including reuse, recycling, recovery, resale, donation, scrapping, transfer, or disposal. Any salvage, scrap, resale, or recovery value belongs to Houston's Own unless a different arrangement is stated in writing before removal.

8. Third-party resources

Houston's Own may use appropriate subcontractors, independent service providers, rental vehicles or trailers, dumpsters or containers, equipment providers, disposal or recycling facilities, and other third-party resources to perform or support a project. Use of such resources does not imply that Houston's Own owns the equipment or facility involved.

9. Payment and deposits

Unless different written terms are approved, payment is due upon completion of the agreed work. Houston's Own may require a deposit or advance payment for larger projects, rentals, dumpsters, equipment, materials, special disposal costs, or other committed project expenses. Accepted payment methods may include cash, Zelle, check, card, and invoice where approved. Commercial credit or net-payment terms apply only when expressly approved in writing.

10. Cancellations and scheduling

Scheduling and cancellation terms may vary by project. Customers should notify Houston's Own as soon as possible of a cancellation, delay, or access problem. Houston's Own may establish project-specific cancellation, rescheduling, mobilization, rental, or nonrefundable committed-cost terms when circumstances warrant, provided those terms are communicated for that project.

11. Property condition and pre-existing damage

Customers should identify fragile surfaces, concealed conditions, restricted areas, and known pre-existing damage before work begins. Houston's Own may document site and item condition before, during, and after work. Houston's Own is not responsible for pre-existing conditions or damage caused by undisclosed defects, unsafe conditions, or conditions inherent in moving an item through access that the customer directs us to use, except to the extent responsibility cannot lawfully be limited.

12. Project photographs

Houston's Own may photograph work areas, items, loads, and completed work for operational documentation, estimating, safety, quality control, and recordkeeping. Houston's Own may also use non-identifying project imagery to illustrate its work or capabilities. Marketing use is intended to avoid identifying customers, people, exact street addresses, license plates, account information, or other private information. A customer may request that project imagery not be used for marketing by contacting us before or during the project.

13. Completion and concerns

The customer should raise visible scope or completion concerns promptly so they can be reviewed while the conditions can still be evaluated. Removal services do not include cleaning, repair, demolition, utility work, hazardous-material remediation, or other work unless specifically included in the agreed scope.

14. Applicable law

Services are subject to applicable federal, Texas, and local law. Nothing in these Service Terms waives rights or remedies that cannot lawfully be waived.
